Client Brian came to our office because his employer did not pay him overtime. Brian worked in a supervisory position with a national security guard firm. Brian’s employer claimed that it did not need to pay Brian one and one-half his regular rate of pay because he was a manager, exempt from the overtime provision of the Fair Labor Standards Act.

After investigating the situation, our attorneys found that the employer owed Brian overtime pay for a three-year period.

Our attorneys filed a lawsuit against the company on a collective action basis on behalf of not only Brian, but on behalf of all other employees affected by the company’s illegal pay practice. Although the company fought tooth and nail every step of the way, the court ordered that our office could send all the employees in the company with similar positions to Brian a notice letting them know of their right to join the case.

After receiving notice in the mail of their right to join, multiple other employees joined Brian’s case. The office was able to force the company to give it the time and pay records for all the employees who joined Brian’s case. After investigating their claims, the attorneys were able to negotiate a settlement for the collective action, where each employee received 100% of their back wages and an additional 40% of their back wages in liquidated damages. That means they received more than they were even owed if the company would have paid the employees correctly in the first place.
